Terms and Conditions
While using the Double Digit Art website you will not: post content that violates any laws, third party rights, or the intent of this site; fail to deliver payment for items purchased by you; fail to deliver items purchased from you, unless the buyer fails to meet the posted terms; manipulate the price of any item or interfere with the listings; circumvent or manipulate our fee structure, the billing process, or fees owed to Double Digit Art; post false, inaccurate, misleading, defamatory or libelous content including personal information; transfer your account to another party without the written consent of Double Digit Art; distribute or post spam, chain letters, or pyramid schemes; distribute viruses, worms, Trojan horses, or other malware technologies that may harm this site, or it s users; copy, modify or distribute content from this site; harvest or otherwise collect information about users, including email addresses without their consent. Additionally you are prohibited from using this site if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our site.
Without limiting other remedies, Double Digit Art may limit suspend or terminate our service and user accounts, prohibit access to our website, delay or remove hosted content, and take technical and legal steps to keep users off the sites if we deem it necessary. DDA also reserves the right to cancel unconfirmed accounts or accounts that have been inactive.
No Business Relationship
No agency, partnership, joint venture, employer-employee or franchiser-franchisee relationship is intended or created by this Agreement.
Representation of Artist
Selling artist represents and warrants that artist has complete and unencumbered ownership of the product (work of art), and that artist has the right to sell the product without violating the rights or infringing on the copyright of any third party. Artist expressly represents and warrants that artist owns an unrestricted copyright to the product listed.
No Warranties, No Damages
Double Digit Art shall not be responsible for any damages as a result of any dispute arising from the use of this site. There are no warranties of fitness for a particular purpose, and no warranties related to the suitability, content or quality of the products displayed on this site. Any dispute must be resolved in accordance with the Dispute Resolution section.
Indemnity
You will indemnify and hold Double Digit Art and all its agents, employees or successors harmless from any claim or demand, including court costs and reasonable attorney fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
Dispute Resolution
Double Digit Art places a premium on the prompt and informal resolution of disputes. If there is a dispute, you must first contact us at the email address provided within fifteen (15) days after the dispute arose, and we will review your claim and attempt to achieve a resolution, if such action is warranted. If the matter cannot be resolved informally, then it may be submitted to Alternative Dispute Resolution as provided in accordance with Indiana statute. In no event shall any claim be filed in a court of law unless ADR has been exhausted and has failed to achieve a resolution, or unless agreed by all parties in which event such claim must be filed in Indiana. By their assent to this Agreement, all parties expressly agree to submit to the personal jurisdiction of the State of Indiana and in all respects this Agreement shall be governed by the laws of the State of Indiana. Should any user violate this section, Double Digit Art will be entitled to recover its reasonable attorney fees.
Changes to Agreement
Double Digit Art reserves the right to update and modify this Agreement from time to time. Each user of this site is charged with the responsibility to check this Agreement to keep advised of any such updates or modifications. Updates and modifications are effective upon posting. This Agreement contains the entire understanding between DDA and any visitor to, or user of this site, and said Agreement cannot be amended or modified without the written permission of Double Digit Art.
Construction of Agreement
If any provision or section in this User's agreement is determined to be void or unenforceable, that provision or section shall not impinge the validity and enforceability of any other provision.
